Program terms and conditions

Here are the details about USAA SafePilot®.

1. Acceptance of Terms and Participation: These terms and conditions ("Terms") constitute a legal agreement between You and USAA relating to your participation in one of the USAA SafePilot programs. The use of “You” or “your” in these Terms mean all insured drivers including minors and any other operators listed on your current auto policy who you have chosen to enroll in an optional program. “USAA” or “we” means United Services Automobile Association and its affiliates. The Terms apply in addition to, and are not intended to replace, any other contract or agreement that apply in connection with any USAA products and/or services.

1.1 Acceptance Through Download and Participation: You may choose to participate in either a discount program or a usage-based mileage program. Your participation and continued use of the mobile application is expressly conditioned on your acceptance of these Terms that apply to both programs. If you do not agree with any part of the Terms, you should not continue to participate in the program. If you choose to continue to participate, you and any minors whose participation and use you are authorizing, agree to be legally bound by the Terms. Your and their continued use of the mobile application throughout the policy term signify your continued agreement with the Terms. Terms may be updated from time to time and will always be available for your review and downloading. If you do not agree with any updates to the Terms, you should take immediate steps to unenroll from the program by calling or going online to make a change to your policy choice. In conjunction with unenrollment, you and other insureds who have participated in one of the programs should delete the app from your mobile device and discontinue use.

1.2 Continued Acceptance and Participation: Continued use and participation through each renewal term is expressly conditioned on your continued acceptance of the Terms in place at that time. You may continue to review the Terms and all updates. All versions of the programs’ Terms are available for your review within your app or at https://www.usaa.com/insurance/safedriving/program-terms-and-conditions. Continued use and participation in either program by you and any end user on your policy serves as confirmation of  acceptance of all Terms. If any updates to Terms are not acceptable, you should take immediate steps to unenroll from the program by calling or going online to make a change to your policy choice. In conjunction with unenrollment, you should delete the app from your device and discontinue use.

1.3 Age of Majority Acceptance: If you entered into a program as a minor through the acceptance of any agreements and Terms by a parent or guardian who named you on their policy, your parent or guardian also accepted Terms on your behalf and permitted you to enroll and participate in a SafePilot program. Once you have reached the age of majority, you are required to read the Terms and determine if you are accepting them and continuing to participate in the program. If you choose to accept them, you may keep using the mobile app, keep it downloaded on your phone, keep all permissions enabled as required for use and continue to send and allow us to use data as specified in these Terms. If you do not agree to any of the Terms, while this will not affect your policy coverage, you may not continue to use the mobile app or participate in the program. You should delete the app from your phone and advise us of your unenrollment. If you unenroll from the usage-based mileage program everyone else named on a policy with you will be required to unenroll from the program, but we will continue to provide uninterrupted coverage to everyone through a traditional auto policy. Policy rates will be affected by any change in programs. We will notify the named insured on the policy of the need to have you review and approve these Terms, or of any changes to the policy caused by your non acceptance.

1.4 PROGRAM NOTICE: EACH PROGRAM WITHIN USAA SAFEPILOT IS AN OPTIONAL LIMITED OFFERING. AVAILABILITY IN YOUR STATE OF ANY OF THE PROGRAMS IS DEPENDENT ON YOUR STATE’S REQUIREMENTS FOR EACH PROGRAM AND THE FILINGS IN YOUR STATE. THE ACCURACY AND PERFORMANCE ON THE USAA SAFEPILOT MOBILE APPLICATION IS NOT GUARANTEED AND SPECIFIC FEATURES MAY VARY BY STATE. EACH PROGRAM IS SUBJECT TO BEING DISCONTINUED AT ANY TIME.

2. Enrollment, Eligibility and Device
2.1 Enrollment: To enroll in either the discount or usage based mileage program and to begin to use the USAA SafePilot mobile app, you must purchase and be a named insured or spouse on a USAA auto policy and, as applicable, have the authority to express consent for all rated drivers including minors and operators who you ask us to insure as well as all vehicles you place on your policy. The Terms apply to all insureds on your policy who choose to participate. With your authorization and consent, all minors are subject to the same Terms to which you agree and continue to agree to from the time of enrollment. No insured who is listed or added to your policy is ever required to participate. However, participation in the usage-based insurance program is required of all insureds on your policy, if you choose that program. The programs are voluntary.

2.2 Eligibility: USAA reserves the right to restrict access to or use of its programs as necessary to satisfy legal or regulatory requirements that either presently exist or may exist in the future.

2.3 Device Capabilities and Updates: To participate in either program, you are required to download and install the USAA SafePilot app. The mobile app is available on the Apple App store and Google Play store.  All participants including the minor children you enrolled and authorized to participate must also download and install the app. You will be required from time to time to install software updates. Certain features of USAA SafePilot may require specific hardware elements, such as wireless internet access capability, Bluetooth antenna, or other. You will be prompted at set up to keep certain features of the phone always active. When you do not follow prompts, the app won’t operate as designed and determination of your discount or monthly premium may be affected.

3. Termination of Access: USAA may, at any time, suspend your access to USAA SafePilot mobile app, or any components thereof, at its discretion. You may uninstall and stop using the app at any time. You should uninstall USAA SafePilot if you transfer your device to someone else. USAA may, without prior notice or liability, discontinue or change any aspect of the programs. This includes restricting or removing access to specific features or data which may previously have been accessible.

1.2 These terms and conditions ("Terms") constitute a legal agreement between you and any other named driver on your auto policy enrolled in the safe driving program (collectively referred to as "you") and United Services Automobile Association and its affiliates (collectively, "USAA" or "we") for your participation in the USAA safe driving program. 5.3 Use of Data: Data collected through USAA SafePilot will be used to power the USAA safe driving program, including determining your driving score. 5.4 Program Results: Program results are available to you solely through USAA SafePilot. You are able to dispute and adjust the assignment of any trip that you have taken during the most recent 30 days within the app, or through an insurance professional at 800-531-USAA (8722) for any trips beyond 30 days. USAA PROVIDES USAA SAFEPILOT AND THE SAFE DRIVING PROGRAM "AS-IS" AND "AS-AVAILABLE" AND IS NOT RESPONSIBLE FOR INCOMPLETE OR INACCURATE DATA. DATA COLLECTED, INCLUDING RAW DATA, WILL NOT BE MADE AVAILABLE EXCEPT AS OTHERWISE PROVIDED HEREIN OR AS REQUIRED BY LAW.

5.5 Program Discount
Participation Discount
Upon enrollment, a participation discount will be applied to the auto policy in participating locations. If all drivers in the household do not choose to participate, the participation discount will be reduced and applied based on a proportion of the number of participants. For example, if the maximum available participation discount is 10% and a household of two drivers only elects to have one driver participate, the participation discount will be reduced to 5%.

Earned Driving Discount
Following enrollment, download and use of USAA SafePilot, USAA SafePilot will begin capturing the driving behavior. During the first 14 days, participants will be provided with feedback on their driving behavior. However, the driving behavior of the first 14 days will not be used in the determination of the driving score. After 14 days, the driving behavior will be used in the determination of the driving score. Participants will continue to receive feedback on their driving behavior.

At the end of the participants' initial policy term, the driving score will be converted to an earned driving discount to be applied to the auto policy in participating locations for each participant that has driven at least at minimum 325 miles and 16 hours each term. USAA SafePilot will continue to collect data during the next term for the purpose of scoring the driving behavior to determine if an earned driving discount can be applied for subsequent renewals.

If USAA SafePilot did not receive enough driving behavior information during the policy term, the participation discount will apply while USAA SafePilot collects driving behavior to establish a driving score. The participation discount can be applied up to 365 days if there is not enough data to determine a driving score at each renewal.

5.6 Disclaimer
USAA SafePilot is intended to be used solely in hands free mode. Use of a mobile or handheld device is at your own risk and subject to applicable local, state and federal laws. You agree to hold USAA and our service providers harmless for your use of USAA SafePilot, including but not limited to your failure to abide by relevant laws and regulations while driving.

If you no longer wish to receive such messages, you agree that you will opt-out through the instructions provided. If you have reason to believe that others on whose behalf you have relayed consent to receive such messages no longer wish to receive such messages, you agree you will instruct them to opt-out following the instructions provided. You also represent and warrant to USAA that each person you have instructed us to message understands that each person is responsible for the cost of any message charges assessed by their mobile carrier, including any international message charges that may apply when messages are transmitted from US-based numbers.

5.3 Use of Data: Data collected through USAA SafePilot will be used to power the USAA safe driving program, including determining your driving score. By participating in the USAA safe driving program, you consent to the transmittal, download, retrieval, access, storage, and use of the data by USAA and our third party service providers. Data may be used for any purposes consistent with the terms of your USAA auto insurance policy. Data may also be used for other business purposes, including: 1) understanding adherence to the Terms; 2) working with third party service providers to assist us with research, analysis or other services; 3) detecting and preventing fraud; 4) detecting and analyzing collisions; and 5) developing and implementing new rating factor and scoring models. Nothing contained herein prevents USAA from using the data in determining future availability of insurance or premium amount. Finally, for the avoidance of doubt, data may be used and/or discoverable in a lawsuit or a claims investigation.

5.4 Program Results. Program results are available to you solely through USAA SafePilot. USAA SafePilot may help promote safer driving; however, USAA MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING USAA SAFEPILOT AND THE SAFE DRIVING PROGRAM. USAA DOES NOT REPRESENT OR WARRANT THAT USAA SAFEPILOT AND/OR THE SAFE DRIVING PROGRAM WILL RESULT IN SAFER DRIVING; NOR DOES IT REPRESENT OR WARRANT THAT USAA SAFEPILOT AND/OR THE PROGRAM WILL PREVENT UNSAFE DRIVING, COLLISIONS OR OTHER HARMFUL EVENTS.

Enrollment & Participation Discount
Upon enrollment, a participation discount will be applied to the auto policy in participating locations. If all drivers in the household do not choose to participate, the participation discount will be reduced and applied based on a proportion of the number of participants. For example, if the maximum available participation discount is 5% and a household of two drivers only elects to have one driver participate, the participation discount will be reduced to 2.5%.

Renewal Discount
Following enrollment, download and use of USAA SafePilot, USAA SafePilot will begin capturing the driving behavior. During the first 14 days, participants will be provided with feedback on their driving behavior. However, the driving behavior of the first 14 days will not be used in the determination of the driving score. After 14 days, the driving behavior will be used in the determination of the driving score. Participants will continue to receive feedback on their driving behavior.

At the end of the participants' initial policy term, the driving score will be converted to a discount to be applied to the auto policy in participating locations. USAA SafePilot will continue to collect data during the next term for the purpose of scoring the driving behavior to determine if a driving discount can be applied for subsequent renewals.

If USAA SafePilot did not receive enough driving behavior information during the policy term, the participation discount will apply while USAA SafePilot collects driving behavior to establish a driving score. The participation discount can be applied up to 365 days if there is not enough data to determine a driving score at each renewal.
